NOTICE TO THE PUBLIC

6.A LU-2020-0033 For Possible Action: Discussion and possible action regarding a request from Wood Rodgers, Inc (“Applicant”) for a time extension for an approved special use permit (“SUP”) to allow for the construction and operation of a concrete batch plant and rock crushing operation with silos exceeding 45-feet in height, on property zoned General Industrial Airport (“GIA”), located at 4500 Ryan Way, Assessor’s Parcel Number (“APN”) 005-072-06. Staff Summary: The Planning Commission approved this SUP on October 28, 2020, subject to 19 conditions of approval.  On October 21, 2021, a one-year time extension was approved by staff.  The Planning Commission granted an additional one-year time extension at its October 26, 2022 meeting. The applicant had requested a full 18-month extension, but because of staff’s error in agenizing the matter, the Planning Commission could only consider the one-year extension.  Therefore, this item is included in this agenda for the Planning Commission to consider the additional six-month extension as requested.  Carson City Municipal Code (“CCMC”) 18.02.080(8)(c) authorizes the Planning Commission to approve additional extensions of time if circumstances beyond the control of the Applicant result in failure to complete applicable SUP conditions and commence the use.

6.B LU-2022-0433 For Possible Action: Discussion and possible action regarding an application from Jennifer Cid (“Applicant”) for a special use permit (“SUP”) to allow a beauty salon on property zoned General Office (“GO”), located at 603 E Robinson Street, Assessor’s Parcel Number (“APN”) 004-232-01. Staff Summary:  The Applicant proposes to convert the existing 2,156 square foot office building into a beauty salon.  Carson City Municipal Code (“CCMC”) 18.04.115 allows beauty shops in the GO use district, subject to first obtaining an SUP.  The Planning Commission has the authority to approve the SUP.

6.C LU-2022-0439 For Possible Action: Discussion and possible action regarding an application from the Advocates to End Domestic Violence (“Applicant”) for a special use permit (“SUP”) to allow for a multi-family dwelling on property zoned General Commercial (“GC”), located at 3649 Gordon Street, Assessor’s Parcel Number (“APN”) 008-303-41. (Heather Ferris, hferris@4dian8.com)

Staff Summary: The Applicant proposes to construct a single story, six-unit multi-family apartment complex.  Site amenities include on-site storage for residents and open space areas for play, gardening and a walking path.  Multi-family residential development requires an SUP in the GC use district.  The Planning Commission is authorized to approve the SUP.

6.D  ZA-2022-0403 For Possible Action: Discussion and possible action regarding an application from Will Adler on behalf of Green Thumb Industries Inc. (“Applicant”) for a recommendation to the Board of Supervisors (“Board”) regarding an ordinance adding marijuana retail stores and medical marijuana dispensaries to the Retail Commercial (“RC”) use district and amending the location requirements for medical marijuana dispensaries and marijuana retail stores in the General Commercial (“GC”) and General Industrial (“GI”) use districts. Staff Summary:  The Applicant has provided two different options for the Planning Commission’s consideration.  With option 1 the Applicant is proposing to amend Carson City Municipal Code (“CCMC”) 18.04.130 to allow medical marijuana dispensaries and marijuana retail stores as a conditional use in the RC use district; and amend CCMC 18.04.135 and 18.04.150 to allow marijuana retail stores and medical marijuana dispensaries in the GC and GI use districts, as a conditional use, without being limited by specific Section, Township and Range.  With option 2 the Applicant is proposing to amend CCMC 18.04.130 to allow medical marijuana dispensaries and marijuana retail stores as a condition use in the RC use district in specific Sections, Townships and Ranges; and amend CCMC 18.04.135 and 18.04.150 to expand the Sections, Townships and Ranges where marijuana retail stores and medical marijuana dispensaries are allowed in the GC and GI use districts.  Per CCMC 18.02.075, the Planning Commission makes a recommendation to the Board regarding a request for a zoning code amendment.  The Board is authorized to amend the CCMC.

6.E LU-2022-0435 For Possible Action: Discussion and possible action regarding an application from Marshall Stokes (“Applicant”) for a special use permit (“SUP”) to establish a tattoo parlor on a property zoned Retail Commercial (“RC”) located at 1802 North Carson Street, Assessor’s Parcel Number (“APN”) 001-091-08.  (Heather Manzo, hmanzo@4dian8.com)

Staff Summary:  The Applicant is proposing to establish a tattoo parlor within an existing tenant space.  An SUP is required.  The Planning Commission is authorized to approve the SUP.

6.F LU-2022-0430 For Possible Action: Discussion and possible action regarding an application from Lennar Reno, LLC (“Applicant”) for a special use permit (“SUP”) to allow a temporary tract sales office, model homes, parking area and advertising signage on properties zoned Single Family 6,000 – Specific Plan Area (“SF6-SPA”) located at 10, 36, 76 and 101 Wildcat Peak Drive, Assessor’s Parcel Numbers (“APNs”) 004-401-01 through -03 and 004-402-02. Staff Summary:  The Applicant is requesting to convert two single-family residential structures into model homes, construct a temporary tract sales office within one of the model home garages and construct temporary parking areas and signage advertising the sale of new homes within the subdivision.  Temporary tract sales offices are a conditional use in the SF6-SPA use district, requiring approval of an SUP.  The Planning Commission is authorized to approve the SUP.

6.G LU-2022-0467 Discussion and possible action regarding an application from Susan Maroc (“Applicant”) for a special use permit (“SUP”) to allow a replacement auto body paint booth and an associated building and an existing auto body repair facility on property zoned Limited Industrial (“LI”), located at 2344 Conestoga Drive, Assessor’s Parcel Number (“APN”) 008-816-52.(Hope Sullivan, hsullivan@4dian8.com)

Staff Summary:  The Applicant proposes to replace an existing auto body paint booth at the existing business.  Although the auto body repair business has been at this location since the 1980’s and there is evidence of building permits, no SUP exists.  The new auto body paint booth will be housed in a newly constructed 1360 square foot metal building.  Carson City Municipal Code (“CCMC”) 18.04.145 allows auto body repair and painting in the LI use district, subject to first obtaining an SUP.  The Planning Commission has the authority to approve the SUP.

6.H LU-2022-0326 For Possible Action: Discussion and possible action regarding an application from Peter Wilday (“Applicant”) for a special use permit (“SUP”) to allow for the construction of a congregate care facility and multi-family residential units on a property zoned Retail Commercial (“RC”) located at 4500 North Carson Street, Assessor’s Parcel Number (“APN”) 007-531-26. Staff Summary:  The Applicant has requested a SUP to construct three 3-story congregate care facility buildings containing a total of 369 beds, administrative and amenity buildings and onsite amenities to include outdoor resident recreation areas, dog parks, flower and vegetable gardens and other site improvements.  The Applicant is also requesting an SUP for a residential use in a non-residential zoning district to include 12 caregiver apartment units.  The Planning Commission is authorized to approve the SUP.
